NEILLSVILLE, Wis (WSAU) Gun rights’ supporters are praising a ruling by a central Wisconsin judge who declared the state’s long-time ban on concealed weapons unconstitutional. Clark County Circuit Judge Jon Counsell dropped a concealed carry charge this week against 27-year-old Josh Schultz of Sauk City, who was arrested for having a knife in his waist-band. Judge Counsell said the state’s concealed carry ban for everyone but law enforcement is not tailored enough to achieve a compelling government interest. And that’s backed up by recent U-S Supreme Court cases that overturned gun bans in Chicago and Washington.
Nik Clark of Wisconsin Carry Incorporated called the ruling a “great step forward,” and it’s in line with other recent decisions. The ruling does not set a statewide precedent. But Schultz’s attorney, William Poss, says that could change if the case is appealed, which he expects will happen.
He says the issue will ultimately go to the Wisconsin Supreme Court, and maybe the U-S Supreme Court.
