WAUSAU, WI (WSAU) Former high school basketball coach Rory McKellips failed to get his conviction on using a computer to facilitate a sex crime overturned on Friday.
McKellips argued that since a jury found him not guilty of two charges of sexually assaulting the victim, he could therefore not be guilty of using the computer to facilitate a crime that didnt happen.
Judge Mike Moran would not reverse the conviction saying the evidence at trial was convincing and demonstrated McKellips intent.
McKellips is jailed in Marathon County and is scheduled to be sentenced on Dec. 6th. He also faces perjury charges, along with his wife, in connection to testimony in the case. That trial is scheduled Nov.18th.
