WISCONSIN RAPIDS, Wis. (WSAU) -- The legal battle between a Wood County town board and a proposed large scale dairy operation is continuing, but with a couple of charges.
Golden Sands Dairy sued the Town of Saratoga back in August of 2012 for passing a moratorium on building projects and creating additional zoning rules to block a proposed 5,300 cow milking operation.
Saratoga officials and their lawyers filed a motion to dismiss the case, and it was discussed in court Tuesday. In all, there were ten claims in the original lawsuit against Saratoga’s board. Four of them have either been dropped or dismissed by the court. Another claim will be reviewed by the court later if a summary judgement is necessary. That leaves five of the claims still active, so the lawsuit will continue.
Judge Thomas Eagon ordered the case to continue to determine if the board exceeded its authority when it put the moratorium and additional zoning rules in place.
The attorneys involved have not been available to comment on the case.
No trial date has been set.
