MADISON, WI (WSAU) -- Wisconsin Attorney General Josh Kaul has filed a request with the GOP-controlled Legislature to withdraw the state from a lawsuit against the Affordable Care Act.
Kaul reportedly made the request Thursday afternoon shortly after announcing he would not fulfill Democratic Governor Tony Ever's instructions to remove the state from the suit, saying he can't do that without approval from lawmakers.
Evers referenced his desire to have the Wisconsin removed from the suit in his State of the State address, but later reversed course saying he hadn't directed Kaul to take the action.
Republican leaders have confirmed they received the request, but wouldn't comment further on the matter. It's unlikely the request will be fulfilled.
A bill passed during a lame-duck session made it illegal for the Evers administration to pull the state out of the lawsuit on their own. Evers had made the issue one of his campaign promises.
