MADISON, WI (WSAU) -- The Republican-held legislature has filed a lawsuit to reopen the state early.
Tuesday afternoon a lawsuit was filed by the Wisconsin Legislature against DHS Secretary-Designee Andrea Palm. The lawsuit claims Palm and the state DHS violated governing emergency rules with Emergency Order 28, the "Safer at Home" order.
The lawsuit seeks a temporary injunction against the Emergency Order to declare it unlawful. The suit also alleges that the Emergency Order "irreparably harmed the Legislature by depriving it of the ability to exercise its statutorily prescribed oversight...".
The injunction would last for six days to allow the DHS time to put together a new Emergency Order.
No counter lawsuit has been filed by the DHS or Secretary Designee Andrea Palm as of 5:00 p.m. on Tuesday. The state Supreme Court has ordered that Palm and the DHS file a response to the lawsuit by 4 p.m. on April 28th.
