MIDDLETON, WI (WSAU-MetroSource) The Dane County District Attorney's Office cleared the four law enforcement officers who shot and killed a gunman at a Middleton office building. DA Ismael Ozanne said, “An active and armed shooter, not responding to commands leaves, law enforcement really no other option."

The four officers, two from Middletown PD and two Dane County sheriff's’ deputies, had been on administrative leave. They are now cleared to return to active duty.

Ozanna also revealed that gunman Anthony Tong used a gun built from parts he got without having to undergo a background check. Tong shot and injured four co-workers at WTS Paradigm in September before being shot by officers who responded to the scene. He died later at the hospital.

Tong, 43, was under a mental health hold in South Dakota. Law enforcement there never entered the case into a national database.

The motive for the shooting hasn’t been determined.
